Annulment in Oklahoma

Information

You can ask an Oklahoma court for an annulment if you can establish two (2) things:

  1. Residency
  2. Reason or Grounds for an annulment
Residency:

You must meet one of the following:

  1. the marriage was performed in Oklahoma OR
  2. one of the parties to the marriage is a current resident.

To be a resident of Oklahoma for an annulment you must: 

  • be a resident of Oklahoma for 6 months "in good faith" and
  • have been a resident of the County you are filing in, for more than 30 days
Reason or Grounds for an annulment:

You must meet one of the following:

  1. If one of the parties to the marriage was NOT eligible to be married at the time of the marriage
    1. if they were under 18,
    2. mentally incompetent,
    3. married to some other person at the time of the marriage
    4. if they had been divorced from someone else for less than 6 months
  2. OR the marriage has not been consummated
  3. OR the person asking for the annulment was tricked or deceived into marrying the other person by some type of "fraud.
